Real Estate Contracts

NOTARY CERTIFICATION OF CONTRACTS WITH IMMOVABLE PROPERTY (APARTMENTS, RESIDENTIAL AND NON-RESIDENTIAL BUILDINGS AND STRUCTURES, LAND PLOTS, MORTGAGES ETC.)

Documents that you need to have with you:

  • Originals of passport/identity card/residence permit/certificate of stateless person, of the parties to the transaction or their representatives
  • Title documents confirming the ownership right on real estate (privatization contracts, purchase and sale, barter, rent contract, certificate of inheritance, state act to the land plot)
  • Technical passport of the real estate unit
  • Notarized consent of the spouses to the transaction or notarized statement of the owner and/or buyer about the absence of marital relations
  • Birth certificate and permission of the guardianship and custodianship agency in the event of alienation of real estate owned by a minor
  • Certificate on absence of encumbrances and claims of third parties on real estate – the original
  • (Only for legal entities) – Constituent and registration documents of the company – originals and copies – or a certificate of legal entity through the egov.kz portal
  • (Only for legal entities) – Decision/protocol of the participant/participants of the company on the conclusion of the transaction
  • (Only for legal entities) – Documents confirming the official/trust authority of company representatives (decisions/protocols of participants/orders for the chief executive officer of the company, powers of attorney)

Notes:

  1. when acquiring real estate for foreign citizens, prohibitions are imposed by the land legislation of Kazakhstan
  2. one of the parents/guardian can sign for a person who HAS NOT reached the age of 14, but persons who HAVE reached the age of 14 sign an agreement independently with the consent of the parents/guardians indicating this fact in the agreement
  3. the consent of the spouses must be notarized
  4. in the case of a transaction between relatives – supporting documents
  5. certificate on the absence of encumbrances and claims of third parties on real estate, issued on the official form of the authorized body of justice or received through the egov.kz portal, is valid one day from the date of receipt
  6. marriage contract (if available) to be submitted to the notary to determine the common property of spouses
